These Terms of Service ("Terms") govern your use of the AquaEscape website (aquaescape.ca) and the purchase of products through our online store. By accessing the site or placing an order, you agree to be bound by these Terms.
About Us
AquaEscape is an online retailer of pool toys, floats, games, and water accessories. We operate warehouses in Canada and the United States and ship across both countries.
Eligibility
You must be at least 18 years old, or the age of majority in your province or state, to place an order. By using the site, you represent that you meet these requirements and that the information you provide is accurate and complete.
Products & Pricing
- All prices are listed in Canadian dollars (CAD) by default and may be displayed in U.S. dollars (USD) via the currency toggle. Your order will be charged in the currency selected at checkout.
- We make every effort to display accurate pricing and product information, but errors may occur. We reserve the right to correct any errors and to cancel any order placed at an incorrect price.
- Product images are for illustration. Colour and appearance may vary slightly due to monitor settings and manufacturer updates.
- Promotions (including the Summer "Buy 1 Get 1 Free" promotion) apply only to eligible items and may be withdrawn or modified at any time without notice.
Orders & Payment
- Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion.
- Payment is processed securely by Stripe, our third-party payment provider. We do not store your card details on our servers.
- Accepted payment methods include credit/debit cards, Apple Pay, Google Pay, Klarna, and Afterpay (availability depends on country and device).
- Your order is confirmed once payment has been received and you have been redirected to the order confirmation page.
Shipping
Shipping terms, rates, and estimated delivery times are described on our Shipping page. Delivery times are estimates only and not guaranteed. Title and risk of loss pass to you upon delivery to the carrier.
Returns & Refunds
Returns are accepted within 30 days of delivery, in line with our Return Policy. Refunds are issued to the original payment method once the return has been received and inspected.
Cancellations
You may cancel an order before it ships by contacting us at getwristflip@gmail.com. Once an order has been dispatched, it cannot be cancelled and must be processed as a return.
Intellectual Property
All content on this site — including text, graphics, logos, photographs, and the AquaEscape name — is the property of AquaEscape or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use this content for commercial purposes without our written permission.
User Conduct
You agree not to use the site for any unlawful purpose, to interfere with its operation, to attempt unauthorized access to our systems, or to submit false or fraudulent information when placing an order.
Disclaimer of Warranties
The site and its content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Products are covered only by the manufacturer's warranty, where applicable.
Limitation of Liability
To the maximum extent permitted by law, AquaEscape, its directors, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of the site or your purchase of any product. Our total liability for any claim relating to a product shall not exceed the amount you paid for that product.
Product Safety
Pool toys, floats, and water accessories are not safety devices and are not life-saving equipment. Children must be supervised at all times when using our products in or near water. Read all manufacturer instructions and warnings before use.
Third-Party Links & Services
The site may contain links to third-party websites or services (including Stripe, Brevo, and analytics providers). We are not responsible for the content, privacy practices, or terms of those third parties.
